These Terms of Service ("Terms") govern your use of urbanforestpm.com and any other website, subdomain, or web page operated by Urban Forest Property Management LLC ("Urban Forest," "we," "us," or "our") on which these Terms are posted (collectively, the "Website").
By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, please do not use the Website.
You must be at least 18 years old to submit an inquiry, application, or other information through the Website.
These Terms apply to your use of the Website only. They do not govern your use of any third-party portal, payment platform, or other service we link or direct you to, which are addressed in Section 14. They do not govern any lease, property management agreement, or other signed agreement between you and Urban Forest. Section 2 explains which document controls where these Terms and a signed agreement overlap.
In these Terms, "Signed Agreement" means any lease, property management agreement, rental application, addendum, exhibit, disclosure, acknowledgment, or other document that you and Urban Forest have signed or otherwise entered into, including any form promulgated or required by the Colorado Real Estate Commission.
These Terms govern your use of the Website. A Signed Agreement governs the subject matter it addresses. If any provision of these Terms conflicts with, or appears to conflict with, any provision of a Signed Agreement, the Signed Agreement controls.
Nothing in these Terms amends, supplements, waives, or limits any term of a Signed Agreement. We will not treat your use of the Website, or your continued use of the Website after we change these Terms, as agreement to any change to a Signed Agreement. A Signed Agreement may be changed only in the manner that agreement provides.
Sections 9, 10, and 11 — which govern how you may access and use the Website and our rights in Website content — apply to everyone who uses the Website, including parties to a Signed Agreement. Those sections address your conduct on the Website only. They do not limit, condition, or affect any right or obligation you have under a Signed Agreement, including any right to give notice, submit a request, report a condition, or make a payment by a method that agreement permits.
The Website provides information about Urban Forest and the property management and leasing services we offer, rental listings, general market information, and ways to contact us. It is an information and marketing resource.
Using the Website, reading its content, submitting an inquiry, or receiving a response from us does not create a brokerage relationship, a property management relationship, an agency relationship, or a landlord-tenant relationship between you and Urban Forest. Those relationships are established only through a Signed Agreement. Section 4 describes how brokerage relationships are established.
Content on the Website is general information. It is not real estate, legal, financial, tax, or investment advice, and it is not a substitute for advice from a professional familiar with your circumstances. Please do not rely on Website content as the sole basis for a decision about a property, a tenancy, or an investment.
Some content available through the Website, including rental listings, is supplied or displayed by third-party services. Section 14 explains how third-party content and services are treated.
Urban Forest Property Management LLC is a real estate brokerage firm licensed by the Colorado Real Estate Commission, located at 205 E Plum St., Fort Collins, CO 80524. All real estate brokerage services described on or offered through the Website are provided by Urban Forest Property Management LLC, which is a separate brokerage firm from any similarly named company.
Different brokerage relationships are available. Depending on the engagement, we may act as a landlord's agent or as a transaction-broker. Which relationship applies is established only in writing, on the applicable Colorado Real Estate Commission form — the Brokerage Duties Addendum to Property Management Agreement for property owners, or the Brokerage Disclosure to Tenant for prospective tenants.
Browsing the Website, viewing a listing, using any estimate or calculator, or submitting an inquiry does not create a brokerage relationship and does not make you our client. General questions about advertised properties — price range, location, property style — are preliminary. Before we discuss confidential information with you, we will provide the written brokerage relationship disclosure Colorado law requires.
Compensation charged by real estate brokerage firms is not set by law and is fully negotiable. Any fees shown on the Website are our current standard rates and remain subject to negotiation and to the terms of a signed management agreement.
Urban Forest Property Management LLC complies with the federal Fair Housing Act and the Colorado Anti-Discrimination Act. We do not make rental, screening, or service decisions on the basis of disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, marital status, familial status, veteran or military status, religion, national origin, ancestry, or source of income, or on the basis of any other class protected by federal, state, or local law.
Every applicant is evaluated against the same written screening criteria.

Rental listings shown on the Website are prepared and published by Urban Forest Property Management LLC and displayed through a third-party listing platform. The listing content is ours; the platform provides the display.
Availability changes quickly. A property may be leased, or an application accepted, before a listing is updated or removed. A listing is an invitation to inquire. It is not an offer, and it does not reserve a property for you.
Photographs and virtual tours represent the property as it was at the time they were taken. Furnishings, staging, seasonal landscaping, and finishes may differ from the property's current condition. Where a listing shows photographs of a similar unit rather than the unit being advertised, the listing will say so.
Advertised pricing is addressed in Section 7.
If you believe a listing contains an error, please let us know using the contact information below and we will look into it.
The price we advertise for a property is its total price: the maximum total of all mandatory amounts you must pay to rent it, shown as a single figure. We do not advertise a lower figure and add mandatory charges afterward.
Charges for utility usage, government taxes and fees, refundable deposits, and optional charges you can reasonably avoid are not part of the advertised total price. Where a property has an optional charge, such as a pet fee, we state it separately in the listing where the amount is known. Where a charge is mandatory for the property, it is included in the total price.
Security deposits and pet security deposits are refundable, subject to the terms of the lease, and are not part of the total price.
A Costs and Fees Summary itemizing all fees and charges accompanies every lease.
You can contact us through the Website. An inquiry does not reserve or hold a property and does not begin a rental application. Section 3 explains what relationships using the Website does and does not create.
We do not accept rental applications through this Website. When you are ready to apply, we will direct you to a third-party application platform. Your application, any application fee, the screening process, and the disclosures that accompany them are governed by that platform and by the materials we provide you there, not by these Terms.
Submitting an inquiry or an application does not guarantee that a property will be available to you, or that an application will be approved.
When using the Website, please do not:
Use it for any unlawful purpose, or in any way that violates these Terms
Copy, scrape, harvest, or systematically extract listings or other content, whether manually or by automated means, other than crawling and indexing by search engines and AI assistants in accordance with our robots.txt file
Use automated tools to access the Website in a way that burdens, disrupts, or degrades it
Attempt to gain unauthorized access to the Website, to any system connected to it, or to any account
Interfere with the Website's operation or security, or introduce malicious code
Misrepresent your identity or your affiliation with any person or organization
Submit false or misleading information, or submit another person's information without their permission
Harass, threaten, or abuse our staff or anyone else
Use the Website or information obtained through it to send unsolicited commercial messages
We may investigate any use of the Website that appears to violate these Terms.
We may restrict, suspend, or block access to the Website, in whole or in part, if we reasonably believe it is being used in violation of Section 9, or in a way that harms the Website, our systems, or another person. Where it is practical and appropriate to do so, we will say so.
Restricting access to the Website does not affect any right or obligation under a Signed Agreement. It does not limit your ability to pay rent, give notice, request maintenance, report an uninhabitable condition, or take any other step your lease or management agreement permits. If you cannot reach us through the Website, please contact us using the information in the Contact section below.
The text, photographs, graphics, layout, and other content on the Website are owned by Urban Forest Property Management LLC or used under license, and are protected by copyright and other laws.
Photographs and marketing materials we create for a property are owned by Urban Forest Property Management LLC. Where a property owner supplies photographs or other materials, those remain owned by the owner and are used by us under the license in that owner's management agreement. Publication on the Website does not transfer ownership of any materials to you.
You may view the Website and print or save pages for your own personal, non-commercial use — considering a property, or keeping a record of a listing. Section 9 sets out what you may not do.
Our name and logos are protected marks and may not be used without our written permission. Other names and logos appearing on the Website belong to their respective owners.
If you send us an inquiry, we may reply using the method you used to reach us or the contact details you provide.
If you give us your mobile number and agree to receive text messages, we may text you to reply to your inquiry and to arrange showings and appointments. If you separately ask for them, we may also send alerts about new listings. Message frequency varies. Message and data rates may apply. Agreeing to receive text messages is not a condition of renting a property or of any service we provide.
Reply STOP to any message to stop receiving texts. You may also tell us to stop by any other reasonable means, including calling or emailing us. Reply HELP for help. We will act on your request as soon as we can, and in any event within 10 business days.
Mobile carriers are not liable for delayed or undelivered messages.
If you are a resident or a property owner, communications about your lease, your tenancy, your property, or your account are governed by your Signed Agreement and the systems it describes. Some of those systems have their own notification settings, which you manage within them. Stopping the text messages described in this Section does not cancel any notice you are entitled to receive under a Signed Agreement. Where you have asked us to stop sending text messages, we will deliver those notices by another method your Signed Agreement permits.
Our Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the choices and rights you have. It forms part of these Terms.
The Privacy Policy covers how we handle personal information across our business, not only on the Website. If you have a lease or management agreement with us, that agreement and the disclosures provided with it also apply.
We link to third-party portals where residents and owners manage their accounts, make payments, and exchange documents with us. Those portals are operated by third parties. Your use of a portal is governed by your Signed Agreement and by the portal provider's own terms and privacy policy, not by these Terms.
Some content available through the Website, including rental listings, is displayed by a third-party service. Section 6 explains how listing content is produced. We do not permit third-party services on the Website to use information collected there for their own advertising, or to sell it. Those services operate under their own terms, so please review their privacy policies where they apply to you.
The Website may link to websites we do not operate. We provide those links for convenience. We are not responsible for the content, accuracy, or practices of a website we do not operate, and a link is not an endorsement.
If you have login details for a portal, please keep them confidential, and let the portal provider and us know if you believe someone else has gained access.
Please do not use this Website to report an emergency. Inquiry forms and messages sent through the Website are not monitored continuously.
If there is a threat to life or safety, call 911.
If you are a resident, report maintenance issues and urgent property conditions through the channels described in your lease and move-in materials, which include the resident portal and the telephone number in the Contact section below.
You may give written notice of an uninhabitable condition by any of the methods listed in the Warranty of Habitability Notice provided with your lease. Nothing in these Terms limits your rights under Colorado's warranty of habitability or changes the notice methods set out in that Notice.
The Website is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or secure, or that any defect will be corrected.
This Section applies to the Website and its content. It does not apply to the condition of any property, to the services we provide under a Signed Agreement, or to our conduct as a licensed real estate brokerage.
Nothing in these Terms limits or disclaims:
any duty we owe as a licensed Colorado real estate brokerage, including the duty to disclose adverse material facts actually known to us;
any obligation under Colorado's warranty of habitability; or
any liability that cannot lawfully be limited or excluded.
This Section applies only to claims arising from your use of the Website or from these Terms. Claims arising under a Signed Agreement are governed by that agreement, not by this Section.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Website, including lost profits or lost opportunities, even if we have been told such damages were possible.
Nothing in this Section limits any liability that cannot lawfully be limited, or any duty preserved by Section 16.3.
You agree to defend, indemnify, and hold harmless Urban Forest Property Management LLC and its members, managers, employees, and agents against any third-party claim, and any resulting loss, liability, damages, and reasonable attorney fees and costs, arising from:
your breach of these Terms; or
your violation of any law, or of the rights of any third party, in connection with your use of the Website.
This Section does not apply to any claim to the extent it arises from our own negligence, gross negligence, fraudulent conduct, or willful misconduct.
This Section applies only to your use of the Website. It does not replace, limit, or expand any indemnity in a Signed Agreement.
We will notify you promptly of any claim for which we seek indemnity, and you may not settle any such claim in a way that imposes an obligation on us without our agreement.
We want the Website to be usable by everyone, including people who use assistive technology, and we make improvements as we identify issues.
If you have difficulty using any part of the Website, or you need information from it in another format, please contact us using the details in the Contact section below. We will provide the information by another means.
Requests for a reasonable accommodation or modification relating to a property or a tenancy are handled as described in Section 5 and, where applicable, under your lease.
We may update these Terms from time to time. When we do, we will post the updated version here and change the date shown at the top.
Changes take effect when they are posted and apply going forward. They do not change the position on anything that happened before.
Updating these Terms does not change any Signed Agreement. As Section 2 explains, a Signed Agreement may be changed only in the manner that agreement provides, and your continued use of the Website is not agreement to any change to it.
If you do not agree with an update, please stop using the Website.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles.
Any dispute arising from these Terms or from your use of the Website will be brought in the state courts of Colorado.
If any provision of these Terms is held to be unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in full effect.
If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.
Headings are for convenience only and do not affect how these Terms are interpreted.
